Terms of Service
These Terms of Service govern your use of MatchesHost shared web hosting services.
These Terms of Service ("Terms") are an agreement between you ("Customer," "you," or "your") and Matches Technologies LLC, doing business as MatchesHost ("MatchesHost," "we," "us," or "our"). By ordering, accessing, or using any MatchesHost service, you agree to these Terms.
1. Services
MatchesHost provides shared web hosting and related services made available through our website and client billing portal. The specific resources, limits, features, pricing, and billing cycle for your account are those shown on the applicable plan or order page at the time of purchase.
We may update, improve, replace, or discontinue individual features when reasonably necessary to operate, secure, or maintain the service. We will not intentionally reduce a prepaid service in a material way without reasonable notice where practical.
2. Account Registration and Security
You must provide accurate, current information when creating an account and keep your contact and billing information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity performed through your account.
You must notify us promptly if you believe your account, website, email account, or credentials have been compromised. We may require identity or ownership verification before making sensitive account changes.
3. Acceptable Use
You may use MatchesHost only for lawful purposes. You may not use our services to host, distribute, facilitate, or promote content or activity that:
- violates applicable law, regulation, court order, or the rights of another person;
- contains or distributes malware, ransomware, viruses, credential-stealing software, malicious scripts, or other harmful code;
- is used for phishing, fraud, impersonation, identity theft, scams, or deceptive activity;
- sends unsolicited bulk email, spam, mail bombs, or abusive messaging;
- infringes copyrights, trademarks, privacy rights, or other intellectual-property rights;
- attempts to gain unauthorized access to systems, accounts, networks, or data;
- conducts denial-of-service attacks, port scanning, brute-force attacks, cryptomining, botnet activity, or other activity that disrupts shared infrastructure;
- uses shared hosting primarily as a file-distribution, backup-storage, proxy, VPN, scraping, or compute-intensive service where that use materially interferes with other customers.
We may investigate suspected abuse and may restrict or suspend affected services when reasonably necessary to protect customers, our infrastructure, or third parties.
4. Shared Hosting Resources
Shared hosting is a multi-tenant service. Your plan may include stated storage, bandwidth, databases, email accounts, websites, and performance levels, but all accounts remain subject to reasonable-use limits necessary to preserve server stability and security.
You may not intentionally consume excessive CPU, memory, disk I/O, processes, mail resources, or other shared resources in a way that materially degrades service for other customers. If an account consistently exceeds reasonable shared-hosting usage, we may contact you to reduce usage, optimize the application, or move to a more suitable service.
5. Billing and Renewals
Fees are charged according to the price and billing cycle displayed when you order. You authorize us and our payment processors to charge the payment method associated with your account for amounts that become due.
Services may renew automatically when recurring billing is enabled. You are responsible for keeping a valid payment method on file and reviewing invoices and notices sent through the client portal or to your registered email address.
If payment is overdue, we may suspend or terminate the affected service after reasonable billing attempts or notices. Restoration of an overdue account may depend on data availability and may require payment of outstanding charges.
6. Cancellations and Refunds
You may request cancellation through the MatchesHost client area or by contacting us. Cancellation prevents future service after the applicable cancellation or expiration date, subject to the billing settings shown in your account.
Any refund eligibility, promotional guarantee, credit, or cancellation deadline specifically displayed at checkout or communicated to you in writing will control. Except where required by law or expressly promised in writing, payment of an invoice does not by itself create a right to a refund for time already provided or resources already allocated.
7. Backups and Customer Data
You are responsible for maintaining independent backups of your websites, databases, email, files, and other data. Even if backup functionality is made available, backups are provided as a convenience and are not guaranteed to be complete, current, or recoverable.
MatchesHost is not a dedicated archival or backup-storage service. You should maintain copies of important data outside your hosting account.
8. Uptime, Maintenance, and Service Availability
We work to provide reliable hosting, but no internet or hosting service is uninterrupted. Service may be affected by scheduled maintenance, emergency maintenance, software or hardware failures, network issues, security events, upstream provider outages, acts of third parties, or events beyond our reasonable control.
Unless a separate written service-level agreement expressly states otherwise, MatchesHost does not guarantee a specific uptime percentage or uninterrupted availability.
9. Email Use
Email accounts included with hosting are intended for ordinary website and business communication. You may not use the service for unsolicited bulk mailing, purchased mailing lists, abusive campaigns, or activity likely to cause our servers or IP addresses to be blocklisted.
We may temporarily restrict outbound mail or an affected account when we reasonably detect spam, compromised credentials, abnormal sending behavior, or a threat to mail reputation.
10. Security
You are responsible for securing the software and applications you install, including keeping CMS platforms, plugins, themes, scripts, passwords, and other components reasonably updated and secure.
We may take protective action when a hosted account appears compromised or poses a security risk. Protective action may include disabling a script, changing permissions, isolating files, blocking traffic, resetting credentials, or suspending an affected service until the issue is resolved.
11. Third-Party Software and Services
Hosting accounts may use third-party software, control panels, certificate providers, domain services, payment processors, or infrastructure providers. Third-party products may be subject to their own licenses, terms, privacy policies, availability, and technical limitations.
MatchesHost is not responsible for failures or changes caused solely by a third-party product or service outside our reasonable control.
12. Suspension and Termination
We may suspend or terminate a service when reasonably necessary for nonpayment, abuse, illegal activity, security threats, material violations of these Terms, or conduct that threatens our systems or other customers.
Where practical and appropriate, we will attempt to provide notice and an opportunity to correct the issue. Immediate action may be taken for serious abuse, fraud, security incidents, legal requirements, or urgent threats to infrastructure.
13. Customer Content and Responsibility
You retain responsibility for content you upload, publish, send, store, or make available through your account. You represent that you have the rights and permissions necessary to use that content and that your use of it complies with applicable law.
We do not routinely review customer content and do not endorse content hosted by customers.
14. Disclaimer of Warranties
To the maximum extent permitted by applicable law, MatchesHost services are provided on an "as is" and "as available" basis. We disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such warranties cannot legally be excluded.
15. Limitation of Liability
To the maximum extent permitted by law, Matches Technologies LLC and MatchesHost will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, or data arising from use of the service.
To the maximum extent permitted by law, our aggregate liability arising from a particular hosting service will not exceed the amount you paid to MatchesHost for that affected service during the three months immediately preceding the event giving rise to the claim.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Matches Technologies LLC, MatchesHost, and their personnel from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of the service, your content, or your material violation of these Terms.
17. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, security requirements, business practices, or applicable law. The current version will be posted on this page with an updated effective date. Your continued use of the service after an updated version becomes effective constitutes acceptance to the extent permitted by law.
18. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
